Copyright
The 1988 Copyright Act assigns copyright to Smile Photography. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this arrangement without permission in writing to Smile Photography.
Smile Photography reserves the right to display images at their discretion.
Payment
In some instances a deposit is payable to secure a required date. The deposit will be deducted from your final invoice, payable after delivery of the Photographs, CD’s or DVD’s.
Photography
The photographer’s judgement in all matters regarding locations, composition, poses, number of photographs taken and all such like matters shall be deemed to be correct.
Image Quality/ Photographs Sent by Email
Sending images over email will not guarantee quality when viewed on any PC or Macintosh monitors. We cannot entertain complaints about image quality over which we do not have control. The time each image takes to download is dependent on their size and we may have to reduce the quality slightly to make them manageable. The quality will generally be equal to or better than that which can be seen on our gallery page.
Failure
Whilst every care is taken at every stage of the photographic process, in the event of a camera failure, operator error, material failure, or process machine failure, Smile Photography can accept no responsibility for any losses however incurred as a result of any such failure beyond a full refund of the original purchase price.
Photographs Sent by Mail
Smile Photography makes every effort to deliver photographs without risk of damage however; we accept no responsibility for damage to any photographs whilst in transit.
Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
Failure by the Customer to pay for any delivery when due shall entitle us to withhold further deliveries and the Customer shall be liable for any costs incurred by the Supplier relating to such Goods which the Supplier is then entitled to withhold.
Delivery of the Goods shall be made to the Customer’s address and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
Privacy
We shall not use your email address for any purpose other than communications about your web page. We shall not sell or pass on your email address to anyone else.
Your on-line images can only be seen by logging-on to www.smilephotography.net, but we will not be held responsible for any hacking or other activity that bypasses this process.
Changes to Terms and Conditions
Our mission is to provide a quality service to our clients. In order to do so we must reserve the right to change our terms and conditions without notice at any time.
Complaints
The client should raise any complaints with Smile Photography in writing and within 14 days of the client’s images being received. No refunds will be entertained for any reason after this period.
